DMCA rules it's okay to jailbreak your iPhone, but not your iPad

The DMCA (Digital Millenium Copyright Act) has extended the exception that makes it legal to jailbreak your iPhone which will be good news for most of the jailbreak community. It doesn't come without a few hefty caveats though including new rules on unlocking and the fact that tablets, namely the iPad, are not granted the same exception.

The DMCA has recently renewed their exception to make jailbreaking your iPhone legal but it doesn't come without some serious drawbacks this time around. When it comes to unlocking your iPhone, it won't be covered under the exception unless the actual carrier unlocks it for you.

This basically means that any iPhone (or smartphone at all for that matter) that you purchase as of January 2013 will require you to get the carrier's permission in order to unlock it. Software unlocks such as ultrasn0w will be considered illegal. If you've got a smartphone that you've purchased before January 2013, you'll still be covered under the exception but any smartphone purchases made after that date won't receive the benefits of the old exemption.

When it comes to tablets, the DMCA has decided not to grant the same jailbreak exception.

What about tablets? No dice. The Librarian "found significant merit to the opposition?s concerns that this aspect of the proposed class was broad and ill-defined, as a wide range of devices might be considered 'tablets,' notwithstanding the significant distinctions among them in terms of the way they operate, their intended purposes, and the nature of the applications they can accommodate. For example, an e-book reading device might be considered a 'tablet,' as might a handheld video game device or a laptop computer."

The Librarian ruled that "the record lacked a sufficient basis to develop an appropriate definition for the 'tablet' category of devices, a necessary predicate to extending the exemption beyond smartphones."

Nuance Dragon Mobile Assistant launches on Android

Dragon Go! has been given the elbow, with the slightly more professional sounding Dragon Mobile Assistant taking its place. Nuance has expanded on its predecessor's verbal commands, with new functionality for maps (you'll be able to bark direction requests at the new app and it'll plan the route), alongside a hands-free wake-up feature activated by saying "Hi Dragon" -- we hope you have a high embarrassment threshold. Other Siri-esque features include weather updates and dictated SMS and email responses. The beta app can be downloaded below, although compatibility is limited to Android Ice Cream Sandwich and above for now. Nuance is promising more features and increased availability later this year.

The online vault at SI.com contains all sorts of treasures that no one has the time to search for.? Fortunately, one of our readers had both the time and inclination to find an article that I vividly recall reading at at time when I was younger than my kid is now.

In 1979, Sports Illustrated pondered the future of pro football.? Here are some of the quotes, each of which were followed by comments from Frank Deford that best can be described as pre-Internet snark.

?In the year 2000, there won?t be any contact below the waist.? ?Bum Phillips, Head Coach, Houston Oilers.? (Said DeFord in response, ?Yeah, O.K.?)

A dozen years after 2000, Bum?s vision has yet to come to fruition.? But it?s moving in that direction.? And it could take another big step there in the offseason, after the 2011 hit by Bills receiver Stevie Johnson on Chiefs safety Eric Berry and the hit from earlier this month by Jets guard Matt Slauson on Texans linebacker Brian Cushing.

?Players will look a lot different: lighter equipment, more formfitting shoulder pads, a different type of helmet, soft rib pads.? ?Dan Rooney, President, Pittsburgh Steelers.

Of course, we won?t notice any of those differences this weekend when the Steelers play; we?ll be too distracted by the prison bumblebee throwback uniforms.

That?s the argument that has been raised in the wake of the new sensitivity to concussions.? Football could become a way out for the have-nots, and the best of the best eventually will entertain the haves and the have-mores.

The article, after the parade of quotes, focuses on Byron Donzis, a then-47-year-old inventor who had developed a flak jacket and who had all sorts of other ideas (some crazy, some sane) about the future of pro football, from an equipment standpoint. But Deford eventually focuses on broader assessments of the game.

?The feeling is that rosters will grow, but the schedule will not (you believe that?), and that the NFL won?t expand abroad because the foreigners wouldn?t be sufficiently interested in an American game played by Americans,? Deford wrote. ?No, even in 2000 the referees won?t use TV replays to assist them in making their calls.?

It?s an intriguing article. And it makes us wonder how different the NFL will be in another 33 years. Feel free to drop some ideas below.

Stocks stabilize on Wall Street after a sell-off

NEW YORK (AP) ? The steep losses finally stopped Wednesday as the stock market turned calm, a day after one of its biggest sell-offs of the year. Major indexes wavered between slight gains and losses in afternoon trading.

The Dow Jones industrial average climbed 23 points to 13,126 as of 2:30 p.m. The Standard & Poor's 500 index edged up two points to 1,415 while the Nasdaq composite index rose two points to 2,992.

"Today we're assessing the damage," said Mark Luschini, chief investment strategist at Janney Montgomery Scott. "Everybody just got clobbered yesterday."

Lower corporate revenue and expectations for the rest of the year drove the Dow down 243 points Tuesday, its third-biggest drop this year. DuPont, 3M, UPS and Xerox all reported lower sales than a year ago.

"It seemed out of the blue, but what we were seeing was stock prices adjusting to corporate profitability," Luschini said.

The stock market barely budged after the Federal Reserve took no new steps after the end of a two-day meeting. The Fed said it needs time to see whether a new bond-buying effort launched in September will spur economic growth and new hiring.

Facebook was poised for its best day since its stock market debut in May. The company said late Tuesday that 14 percent of its advertising revenue came from mobile devices, allaying some investor concerns.

The social network's stock soared $3.91 to $23.44, a jump of 20 percent. Facebook has swung widely since its IPO at $38, and has traded as low as $17.55.

Boeing, one of the 30 large companies in the Dow, said it expects to deliver more airplanes and raised its estimates for profits this year. Boeing's quarterly earnings also beat analysts' estimates. Its stock dipped 11 cents to $72.73.

Another Dow stock, AT&T, said it added the fewest wireless customers since 2003, far behind Verizon Wireless. AT&T's results still managed to beat the estimates of financial analysts. AT&T slid 17 cents to $34.83.

A measure of manufacturing in China, the world's second-largest economy after the United States, improved this month to a three-month high. China's white-hot economic growth has been slowing.

A drop in profits for Norfolk Southern hit other railroad stocks. Norfolk Southern reported a 27 percent slump in quarterly earnings late Tuesday, as falling coal prices led to lower revenue. Many utilities have favored using cheap natural gas instead of burning coal this year, pushing down coal prices and weighing on railroad operators.

Norfolk Southern fell $4.82 to $61.19. Union Pacific lost $1.94 to $121.27.

Prices for U.S. government bonds inched lower, sending yields up. The yield on the benchmark 10-year Treasury note edged up to 1.77 percent from 1.76 percent late Tuesday.

Among other stocks in the news:

? Netflix dropped $8.27, or 12 percent, to $59.96. Late Tuesday, it slashed its prediction for how many U.S. video-streaming subscribers it would add this year to 4.7 million to 5 million. It had predicted it would add as many as 7 million.

? Dow Chemical rose $1.70 to $30.25. The company announced a wide-ranging restructuring plan late Tuesday that includes cutting 2,400 jobs and closing 20 manufacturing facilities. The company cited slowing economic growth in Europe and elsewhere.

? Tempur-Pedic International sank 19 percent after the maker of memory-foam mattresses reported revenue that was well below the estimates of Wall Street analysts. The company also cut its estimates for full-year profits and revenue. Its stock plunged $6.23 to $25.66.

Iran judicial branch chief fires back at president

TEHRAN, Iran (AP) ? The head of Iran's judiciary lashed out at the country's president Wednesday, the latest salvo in an escalating political conflict that has undermined much of Mahmoud Ahmadinejad's political clout.

The latest issue appeared relatively minor ? Ahmadinejad's intention to visit a prison north of Tehran. The head of the judiciary branch, Ayatollah Sadeq Larijani, said permission from his office was needed to visit Evin prison, and Ahmadinejad angrily rejected that. Larijani retorted Wednesday that the president does not understand his constitutional powers.

One of Ahmadinejad's aides is being held at the prison.

The background is a longstanding clash between Ahmadinejad and Iran's powerful clerics, as presidential elections loom next year. Ahmadinejad cannot run for another term but wants to influence the race to succeed him. His supporters were soundly defeated in parliamentary elections earlier this year.

Ahmadinejad originally had the backing of the clerics, but they broke over his perceived challenge to the authority of Supreme Leader Ayatollah Ali Khamenei last year. The conflict is mostly over internal politics. The two leaders do not differ significantly over policies, especially Iran's contentious nuclear development program.

The latest spat revolves around Ahmadinejad's request to visit the prison where his top press adviser, Ali Akbar Javanfekr, was sent last month after being convicted of publishing material deemed insulting to Khamenei.

On Monday, Ahmadinejad sent a letter accusing the judiciary of "unconstitutional" behavior for rejecting his planned visit to Evin prison. As the country's elected president, he said he did not need permission.

Larijani returned the fire Wednesday.

"(Ahmadinejad's) letter is the result of incorrect understanding of the responsibilities of the three branches of power and the limits of duties," the semi-official ISNA news agency quoted Larijani as saying.

Addressing judicial authorities Wednesday, Larijani said Ahmadinejad does not control the judiciary.

"This assumption that the president has supervision over other branches of power is totally wrong," he was quoted by ISNA as saying. "It is unconstitutional to claim that the president has the right to visit prisons without permission from the judiciary."

The three branches of power operate under the supervision of Khamenei, who has the final say on all state matters.

One of Khamenei's representatives, Ali Saeedi, was quoted by Iranian newspapers this week as charging that Iran's presidents sometimes put themselves in the position of the Supreme Leader and seek to exercise powers well beyond what has been given to them under the constitution ? a clear reference to the clash between Ahmadinejad and Khamenei.

Iran's state prosecutor, Gholam Hossein Mohseni Ejehi, said Sunday that the judiciary rejected Ahmadinejad's request to visit the prison because it appeared to be politically motivated.

Ejehi said Ahmadinejad would do better to focus on Iran's deepening economic problems than to visit Evin. He also asked why the president never asked to visit Evin in his seven years as president but wants to go there now that his close aide is behind bars.

Competitive health insurance bids for school districts will help lower ...

Because of a new law passed by the state Legislature, local school districts across Maine are now able to seek competitive bids in providing health insurance for teachers, staff and their families. Industry professionals estimate possible savings of up to 15 percent for the second-most expensive item in school budgets behind salaries: health insurance for school employees. Expected substantial savings could be used to reduce rising local property taxes.

Local property taxes fund 79 percent of the average Maine municipal budget. According to Maine Revenue Services, property taxes have more than doubled in the past 20 years ? increasing 123 percent. These surging property taxes are making it more and more difficult for an increasing number of Maine families to hold on to their homes.

The local school budget accounts for 61 percent of the cost to operate the average Maine city or town, according to the Maine Municipal Association. For the most part, the cost of public education drives the level of local property taxes. Health insurance for school workers is estimated to cost up to 15 percent of total education expenses.

Local property taxes can be significantly reduced by addressing the high cost of health insurance for school employees.

For many years, the Maine Education Association, the public school teachers? union, has maintained a monopoly in providing health insurance to Maine teachers and staff. The Maine Education Association Benefits Trust has hired one insurance company, Anthem Blue Cross Blue Shield, to provide health insurance for teachers, staff and their families in nearly every school unit in Maine.

Through the years, the MEABT has declined to disclose the medical claims data experienced by the individual school districts. (It is, of course, unlawful to identify any individual in the release of such information.) Without having this ?loss claims data,? no other insurance company will blindly bid for a school district?s health insurance business. If a competing insurance company does, it might grossly overbid the price to provide coverage for a healthy group of school employees filing few medical claims. Or, the competing insurance company might greatly underbid a policy for an unhealthy population filing many expensive medical claims.

After many years of trying, last year 18 Maine state senators and 83 representatives passed a new law requiring the teachers? union to share this medical claims data with their school unit clients. Seventy-five legislators voted against LD 1326, sponsored by Rep. Ralph Sarty, R-Denmark.

Shortly after the new law was passed, the union?s Benefits Trust continued to prevent the release of this basic health insurance loss information by filing suit against the Maine Superintendent of Insurance, the Maine School Board Association and four local school districts. The MEABT lost the lawsuit in the U.S. District Court in Portland. The MEABT then appealed the decision to the 1st Circuit Court of Appeals in Boston. After losing the appeal last week, the teachers? union finally gave up trying to conceal the medical claims data experienced by its Maine school district customers.

Now, school boards across the state will be able to seek competitive bids from insurance companies interested in providing health insurance to their school employees.

Industry professionals estimate that local taxpayers pay $400 million per year to buy health insurance for Maine public school teachers, staff and their families. This cost has contributed to escalating property taxes during the past two decades.

Insurance professionals project possible savings of roughly 15 percent for school districts that put their health insurance needs out to bid. For example, the Regional School Unit 18 school budget is $32 million for 2013. Approximately $4.8 million is directed to pay for employee health insurance. Inviting insurance companies to compete for this business might save Belgrade, China, Oakland, Sidney and Rome taxpayers nearly $720,000 per year, according to insurance company workers. That?s real money that could be used to lower smothering property taxes.

During the teachers? union monopoly in providing health insurance to school employees, Anthem has returned to the union?s Benefits Trust part of the insurance premiums paid by local taxpayers. Those excess premiums sitting at the MEABT have recently reached approximately $86 million. Who ?owns? those excess funds collected from local taxpayers?

Soon, more than 50 Maine school districts will receive for the first time their own employee health insurance loss information. Finally, transparency and free market competition will potentially save boatloads of school-budget dollars. It?s sad that it took a new law to help struggling Maine families reduce their property taxes in order to help them stay in their homes.

Joann Stevens: Arts Righting History | Around The Mall

Before 1973, there was no Asian American music recognized in the United States says Nobuko Miyamoto,?a Japanese singer-dancer credited with creating the nation?s first Asian American album, A Grain of Sand, with co-creator Chris Kando Iijima and William ?Charlie? Chin.

Nobuko Miyamoto helped create a place for Asian Americans in music.

?Now there are 200 taiko drumming groups in the U.S. representing a cultural voice for Asians,? she says proudly. ?I see more (cultural) identity-based things taking place.? There is an element of activism in the community now. ?

Cultural activism in Asian communities is the legacy of artists like Miyamoto, who in the 1960s and 70s, helped to popularize college campuses and communities create ethnic study programs and heritage recognition programs, says Theo Gonzalves, a Filipino scholar, researcher and musician who has studied the era and Miyamoto?s career. He said that today, most people take ethnic and cultural history programs for granted, unaware of the resistance they faced and how civil rights activists like Miyamoto helped make them possible.

?The idea of ethnic studies?was to democratize higher education so that it opened up opportunities for the community at large,? says Gonzalves. ?Artists like Miyamoto ?helped write Asian communities into the national narrative,? using music and art to tell the stories and histories of people who had been misidentified or largely excluded in American history up until that time.

?Art and culture is not just about entertainment.? It?s about examining questions of history.?

Miyamoto will participate in an upcoming panel discussion and program at the Smithsonian on October 19, featuring Afro-Filipino singer Joe Bataan to help foster and facilitate the recalling of this history, and what it was like when people of different ethnicities shared the same spaces and similar stories.

A native of Los Angeles, Miyamoto began her career as a dancer, studying with legends Jerome Robbins and Eugene Loring,? ?who taught me dance was a form of communication.?

She won featured roles in the ?Flower Drum Song,? ?The King and I? and ?West Side Story.? ?An invitation to work on a film about the Black Panthers became a cultural turning point that immersed her in the social activism of the Panthers, the Young Lords and Asian activists, which is how she met Chris Iijima, helping to bring diverse culture and social services to their communities.? Services provided ranged from breakfast programs for children to housing assistance and bi-lingual workers to record community problems.

?We sang at rallies and did gigs for Puerto Rican (activist) groups,? she says, sometimes singing in Spanish.? But even the culture wars had moments of humor.

?We established an Asian American Drop-In Center in a bodega on 88th Street and Amsterdam Avenue,? Miyamoto recalls, ?calling it Chickens Come Home to Roost in reference to a statement made by Malcolm X.?

?People started calling us the chickens, and would ask ?can the chickens come and help us take over a building??

The story of how Asian cultural activists confronted the sixties culture wars to gain a voice in the national narrative will be presented October 19 in a free, Smithsonian Asian Pacific American program?at the National Museum of Natural History.? Miyamoto will participate in a 6:30 p.m. panel discussion followed by a concert with King of Latin Soul singer Joe Bataan.? The Smithsonian Latino Center and? National Museum of African American History and Culture are co-collaborators.

Joann Stevens is program manager of Jazz Appreciation Month (JAM), an initiative of the National Museum of American History to advance appreciation and recognition of jazz as America?s original music, a global cultural treasure.? JAM is celebrated in every state in the U.S. and the District of Columbia and some 40 countries every April.

Details being released into Garrett Reid death

ALLENTOWN, Pa. (AP) ? Officials are planning to release details regarding the investigation into the death of Garrett Reid, the son of Philadelphia Eagles coach Andy Reid.

Northampton County District Attorney John Morganelli is holding a press conference Thursday afternoon.

Garrett Reid was found dead in his dorm room on Aug. 5 at Lehigh University in Easton, where he was assisting the team's strength and conditioning coach during training camp.

He was a recovering drug addict who had seemingly turned his life around. But Andy Reid has indicated that his 29-year-old son may have had a relapse.

If you showed photos of average girls ages fifteen or fourteen to the average man and did not label them with the girls? ages, then all normal men would find them attractive and would react sexually. [This can be measured physiologically, so there is no need to rely on possibly dishonest verbal responses.]

???? The age of puberty in girls ? its onset (menarche) ? is just eleven or below; and therefore a fifteen- or fourteen-year-old girl is several years post-puberty. Not only is she sexually mature but very near her peak of fertility, which is the age at which men have evolved to find females most attractive of all. Furthermore, the girl is not emotionally immature, given that the hormonal surge at puberty is responsible for initiating the adult organisation of the brain. It is no surprise then that surveys show the majority of people ? male and female, let alone just girls ? have already had full sex before their fourteenth birthday.

???? Why, then, is the age-of-consent set in law at age sixteen? This was set back in Victorian times when the average age of menarche was at the astonishingly late age of seventeen. So the age when sex was deemed illegal even back then ? in the context of a wild panic about what was the bogus notion of ?the white slave trade? ? was set actually below the age of female puberty.

???? The age-of-consent law is now a serious anachronism, and means that most people break the law. It is a major infringement of the freedom of young people, especially of boys?given the two-year maturational gap between the sexes and the preference girls have for older males. It is also an inappropriate attack on natural sexual relationships between a girl and a considerably older man, such as in the current case of the fifteen-year-old girl and her thirty-year-old teacher. There are plenty of instances of?pupil-teacher relationships that become marriages with children that long endure. That such relationships are deemed a supposed abuse of authority is no defence for the silly hysteria, because status is the very key attribute of men that girls have evolved to find particularly attractive. The pupil-teacher sexual relationship is ever likely to happen and could not make better evolutionary sense. In the contemporary context of the PC (?political correctness?) totalitarian attack on the mass of ordinary people, the law regarding sex is a direct attack on boys and men.

???? So how does Jimmy Savile ? a notably high-status male ? fall foul of what should be common-sense acceptance of the reality of sex? Only if he did indeed use coercion as alleged; but here is where the likely truth should stop anyone jumping to that conclusion. There is plenty of research showing a very high proportion of even formal allegations of sexual assault to police are fabrications (likely the majority; see the analysis in the book, The Woman Racket); and for often highly trivial reasons ? especially to cover mild embarrassment. Girls and women routinely regret sexual encounters and retrospectively redefine them as coercive. [This must have been much more the case prior to the free availability of near-infallible contraception and the legal availability of abortion.] Then we must add the dimension of also well-researched ?false memory? construction, especially given the great elapse of time ? several decades.

???? This is only the start of teasing out multiple factors that conspire to create a bogus feeding frenzy. Savile?s incredible public profile guarantees attention for the attention-seeker. His death and the absence of any forensics or (other) witness guarantees immunity of even outlandish accusations from being challenged. The media ? let alone the police ? trawl is an open invitation for any of the huge number of girls who had sexual encounters with Savile to come forward with all sorts of fanciful elaborations of what actually took place.

???? The likely reality of Jimmy Savile?s sexual behaviour is that he was a normal man in the abnormal situation, through being high-status and within the pop world in a newly ?sexually liberated? era, of being in the milieu of a large number of girls at the peak of their attractiveness and willing to engage in sexual activity. It would be amazing if, given the volume of sexual activity, that the ever-present problems of mis-communication between the sexes (notably female mixed come-on and coyness signals) would not lead on occasion to sex the girl did not want. A man in a man?s ?dream? position as Savile found himself easily could become used to the sexual activity such that his guard may be lowered as to checking that the girl was fine with what was going on. Of course, it may be also that Jimmy Savile was cavalier and in fact an abuser; but there is no basis of determining this given the nature of any evidence available. The only thing we know for sure is that his high profile more or less obliged him to be larger-than-life, so even his seeming oddness is likely no clue to anything. Myself, I?ve always found him creepy, and I never warmed to the man even in early Top of the Pops days (never mind the cringeworthy Jim?ll Fix It), but that?s probably just a lowly-male reaction to how society indulges the minority of high-status males.

???? The upshot is that an honest view of Jimmy Savile is very much at odds with our contemporary perspective, which is a politically-driven hysteria that will come to be seen as such a madness as to be a warning from history.

Regarding the last line of Moxon?s piece ? I?ve been consoling myself this week with the thought that even if it is not realistic to hope to bring to justice the instigators of the present sexual hysterias in their lifetimes, at least we can document who these monsters are, and what motivated them, for the education of those who come after us.? At least we can be assured that these creatures will ultimately live in infamy and serve as warnings to future more enlightened generations against superstitious sexual savagery and the most primitive of human evil.

Be consistent with her activity. A truly high-energy dog should be exercised every day.

2. Consider a diet switch.

Try to feed a good quality dog food without fillers or sugar in the list of ingredients. Some studies that suggest a lower protein diet can increase the amount of tryptophan (the chemical that makes us sleepy after Thanksgiving dinner) that can act on the brain.

Alternatively, it has been suggested a higher protein diet can actually be more calming by reducing the amount of complex carbohydrates causing energy spikes.

True cases of hyperactivity disorder are rare in dogs, but not unheard of and can be treated similarly to hyperactivity disorder in people.

With time and maturity, some dogs will also become less hyperactive (not always though!), but in the meantime, ensuring you?re doing all you can to help manage their behaviors will undoubtedly make the whole family happier. Dog insurance may also help cover the cost of any prescribed medications.

In today?s market, buying a house requires diligence, a little bit of luck and a lot of planning. But most importantly, your expectations must be in sync with the market.

Here are 10 common pitfalls that could keep you from sealing the deal:

You have large cash deposits but no paper trail
Be prepared to source all cash deposits and transfers into your bank accounts. Are you doing side jobs? Do you get regular cash deposits from a friend or family member? All deposits and transfers from other accounts will need to be sourced.

Your gift money and/or down payment cannot be sourced
Getting money from mom and dad to purchase a house? That?s great; here?s what they will need to provide so you can secure a home loan stress-free:

  • Signed gift letter stating the money is truly a gift.
  • ?Full bank statement showing they had the ability to gift funds.

Your debt-to-income ratio is above 45 percent Your debt-to-income ratio (DTI) is the amount of a new monthly house payment plus other recurring monthly debt divided by your gross monthly income. Most loan programs require that this ratio be at or below 45 percent. You can determine whether a house is within your affordability range in two ways:

  • ?Calculate your DTI: Proposed mortgage payment + all minimum monthly debt obligations ? gross monthly income.
  • ?Calculate your maximum mortgage payment: Gross monthly income ? .45 (45 percent DTI) ? all minimum monthly debt obligations.

You?re self-employed and show losses on your Schedule C

You need a seller credit for closing costs
Many buyers today, especially first-time home buyers, are short on cash to close and need seller concessions for closing costs. But what if the seller doesn?t agree? Be prepared to pay about 3 percent of the purchase price in closing costs, in addition to your down payment.

You?re indecisive
Ideally, you should shop for your loan before making an offer on a house. If, however, your offer is accepted before you choose which lender or loan program you?re going to use, then you will be forced to do one of two things:

  • Commit to working with a lender.
  • ?Cancel the contract if you cannot meet obligations.

The house has structural and/or pest-related issues
These things happen, so be ready for it. If you?re going with a government-backed mortgage for your home purchase, you will be subjected to slightly higher appraisal standards than if you were going with a conventional mortgage.

You?re competing with multiple offers and stronger buyers
So how do you win? Start by asking your mortgage lender to close the transaction in less than 30 days. This increases your negotiating ability.

You have unrealistic purchase price expectations
This happens time and time again: Buyers are very particular about what they?re looking for ? and what they?re willing to pay for it. Most buyers have to compromise at some point along the way, but it often takes multiple offers on several homes for this fact to ultimately resonate. A good real estate agent should be able to advise you of the reasonableness of your offer.

Summary Judgment?Damage Suffered by Investors?Direct Financial Loss?Distinction Between Liability Policy and Fidelity Bond.

Plaintiffs (investors) appealed the trial court?s summary judgment in?favor of Certain Underwriters at Lloyd?s London (Lloyd?s). The judgment was affirmed.

Investors alleged that the chief executive officer (CEO) of Commercial Capital Inc. (CCI) formed CCI as a real estate lending company providing short-term financing for commercial construction projects. During 2006 and 2007, CCI solicited private investors to invest funds in the company. The proposed investment involved the acquisition of debt securities documented by a subscription agreement and promissory note from CCI (notes). Seminars were held by CCI to describe the investment.

Investors alleged that the CEO was involved in all day-to-day operations and made misrepresentations that included: (1) CCI had a $5 million policy in place to protect investors? principal against loss; (2) the investments had high guaranteed rates of return; (3) the interests sold were registered with the Securities and Exchange Commission; (4) the investments were ?more liquid than other private real estate strategies? and ?enjoyed a superior risk return profile due to inefficiencies in the commercial lending market?; (5) CCI would conduct vigorous due diligence before granting any loans; and (6) the investments and any interest would be personally guaranteed by the CEO. Investors alleged that, based on these and other misrepresentations, they invested or loaned money to CCI in an amount in excess of $1 million. CCI is allegedly in default on the notes and the CEO has not honored his personal guarantee.

It appeared that CCI loaned investors? funds to developers at lower interest rates than those payable to investors but with very high loan origination fees. On April 22, 2009, CCI filed a voluntary petition for Chapter 11 bankruptcy. Certain creditors, including investors, moved for relief from the automatic stay to pursue CCI?s rights under Insuring Clause A1(b) of the Mortgage Bankers Bond No. MBB-06-00090 (bond), which was issued to CCI by Lloyd?s. The relief was granted and the bankruptcy trustee assigned all of CCI?s rights, title, and interest in the bonds to investors, retaining 30% of the gross recovery less reasonable attorney fees and $50,000 to be paid to investors, with the balance to the investors.

Investors filed a complaint against CCI, the CEO, and Lloyd?s, alleging that CCI and the CEO officer violated the Colorado Securities Act, sold unregistered securities, committed common law fraudulent misrepresentation, constructive fraud, negligent misrepresentation or omission, civil theft, breach of fiduciary duty, and vicarious liability. Investors also asserted two first-party claims against Lloyd?s: (1) as assignee of the bond, and (2) as a garnishment claim asserting a right to garnish Lloyd?s after obtaining judgment against CCI. Lloyd?s, following some discovery, filed a motion for summary judgment, which the trial court granted. Investors appealed.

Investors conceded on appeal that the policy was a fidelity bond. As such, it is analogous to an insurance policy. As far as an assignment was concerned, an assignee stands in the assignor?s shoes ?and takes ?only as good a claim as his assignor had.?? Therefore, investors? third-party claims were not first-party losses merely because investors were now in CCI?s shoes as first-party claimants. Investors may recover only those losses that CCI could have recovered for itself.

The Court of Appeals framed the issue presented as whether, under the agreed-on coverage, Lloyd?s would be liable to CCI for the damages suffered by investors arising out of the wrongful acts of its officers and employees in marketing interests in CCI to investors. The Court held this was not the case, because the losses asserted by investors did not constitute direct losses to CCI as contemplated by the bond. The bond provided coverage for ?direct financial loss? sustained by CCI. The phrase was not defined. However, the Court again noted that this was a fidelity bond and not a liability policy. CCI could have purchased such insurance, but it did not. Thus, the Court held that ?direct financial loss? unambiguously refers only to the immediate loss of CCI?s property through the dishonesty of its own officers and employees. It does not provide coverage to CCI for acts that cause damages to third parties. The summary judgment in favor of Lloyd?s was affirmed.

Completely independent of the actual data it provides about the state of the Bernal Heights real estate market in September 2012, I think there is something unsettling about the tone and style of this video.

Apart from the fact that I can?t tell if the narrator is a real human or a synthetic text-to-voice robot, the video?s production style reminds me those glossy propaganda messages that are projected on gigantic, larger-than-life video displays in dystopian sci-fi movies like Minority Report or Blade Runner.
